This Privacy Policy relates to our ‘Services’ which include our mobile application (“App”), website (www.mywaffl.com), associated services, functions, content and applications. You should read this carefully in conjunction with our Terms and Conditions before you make use of the services or website from us, My WAFFL Ltd. This Privacy Policy governs the privacy of its users who choose to use our Services.

General

The concept of our Services, in specifically our App, for registered users relies to a great extent on the publication of information regarding individual users to other users by making them accessible via the WAFFL mobile application.

Personal information and e-mail address of a WAFFL App user will not be shared with any other user.

They may, however, be automatically added to the WAFFL mailing lists.  WAFFL may email you newsletters, announcements, surveys or other information. If you prefer not to receive any or all of these communications, you may opt out by following the directions provided within the electronic newsletters and announcements.

Types of personally identifiable information collected by WAFFL App

The App works by communicating with our servers to bring you the WAFFL services. Your personal data will therefore be held on our servers.

WAFFL collects different types of personally identifiable information from users upon registration and in connection with the usage of the WAFFL App. The personally identifiable information collected by WAFFL belongs to the following categories.

A) Profile information which users can freely enter, change and delete via Settings such as: first name and last name, location, gender.

B) Training information that will be stored when users save performances such as: workout times for strength and cardio workouts, exercise repetitions, etc.

C) Training information that will be stored when users save performances such as: meal days, calories, macronutrients, etc.

D) Well-being information that will be stored when users save performances such as: water consumption, sleep advice, etc.

F) Email addresses

Personal identifiable information shall be used i) to run the App ii) to offer new applications to the members iii) to improve such applications and adapt them to the users’ needs.

You accept that WAFFL or third parties assisting it with provision of the App services are permitted to process your personal data on servers outside of the EEA.

Use and sharing of personally identifiable and non-personally identifiable information with third parties

By registering, the user explicitly agrees that WAFFL shall have the right to use all automatically collected personally identifiable information for purposes of the WAFFL App and to provide future services associated with the App. WAFFL does not sell, trade, or otherwise transfer users’ personally identifiable information (see section II above) to outside parties.

However trusted third parties do assist us in operating our App and conducting our business, and whilst doing so will keep your information confidential. WAFFL may also release users’ information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.

WAFFL may also pass personal identifiable information to third parties if the user explicitly gives permission. Apple’s ‘HealthKit’ data will not be used for marketing/advertising purposes or shared with third parties with or without user consent.

WAFFL implements all reasonable measures to prevent unauthorised access by third parties to saved details.

However, WAFFL assumes no liability for the interception, alteration, or misuse of the information you provide to other users by other users.

The user explicitly consents that WAFFL may provide non-personally identifiable information to other parties for marketing, advertising or other uses.

Facebook integration

The App integrates different connections to the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA. It is used to share activities on Facebook and to get Facebook information about WAFFL App users. An overview of Facebook integrations and social plugins can be found here: http://developers.facebook.com/docs/plugins/.

When users enable the Facebook connection in their Settings, the Facebook integration establishes a connection between a user’s smartphone and the Facebook server. Thereby, WAFFL receives information about the user. This information will be treated as stated in section III.

When users share their performances on Facebook and when they invite friends via Facebook, the Facebook integration establishes a connection between a user’s smartphone and the Facebook server. Thereby, the user links information of his WAFFL account to his or her Facebook account. WAFFL does not receive any of this information.

This integration allows Facebook to correlate a user’s usage of the WAFFL application with the corresponding user’s Facebook account. WAFFL as the provider of the WAFFL App does not have any control of the future data usage by Facebook nor over those you share your data with. Users must actively enable the Facebook connection in their Settings in order to be able to share performances on Facebook and invite friends via Facebook. If users do not want Facebook to gain information on their WAFFL App usage or if they don’t want WAFFL to gain information about them via Facebook, they shall leave the Facebook integration disabled as it is in the default settings. Once enabled, users can disable the Facebook connection again in their Settings at any time.

By activating the Facebook connection in his or her settings, the user explicitly consents to the information exchange described in this section.

Google Analytics

WAFFL Services uses Google Analytics, which are analytics services by Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.

These analytics services allow WAFFL to analyse the usage of our Services.

The information about your visit collected by Google is usually transferred to a Google server in the USA and saved there. Google will use the information collected on behalf of the application operator to evaluate the users’ use of the application, to compile reports about the users’ activities within this application, and to provide further services for the application operator related to the use of the application.

WAFFL will not gather any personally identifiable information through Google analytics services.

Mixpanel

WAFFL Services uses Mixpanel, which are analytics services by Mixpanel, Inc., 405 Howard St., 2nd Floor, San Francisco, CA 94105

These analytics services allow WAFFL to analyse the usage of our Services.

The information about your visit collected by Mixpanel is usually transferred to Mixpanel servers in the USA and saved there. Mixpanel will use the information collected on behalf of the application operator to evaluate the users’ use of the application, to compile reports about the users’ activities within this application, and to provide further services for the application operator related to the use of the application.

WAFFL will not gather any personally identifiable information through Mixpanel analytics services.

Referral Scheme & Other Processing of Personal Data

We aim to operate referral incentive schemes and similar initiatives during the course of your use of our Services, details of which will vary as this becomes available. Additionally we may transfer, store and use your contact information to enable us to bring you updates of our Services and related news that might appear within the App, on our website and social media accounts. These activities will require the transfer, storage and use of your data. By accepting these terms and privacy policy you agree to this processing of your contact details.

WAFFL may display advertising within our Services which links to third-party websites or services. If you choose to take action (e.g. click) on the advert then you have deemed to leave the WAFFL service and will be under the terms and privacy of that advertiser. We hold no liability for these sites or goods/services you may choose to purchase from them.

Website

Our website and WAFFL take a proactive approach to user privacy and ensure the necessary steps are taken to protect the privacy of its users throughout their visiting experience. Our website complies to all UK national laws and requirements for user privacy.

Use of Cookies

Our website uses cookies to better the users experience while visiting the website. Where applicable this website uses a cookie control system allowing the user on their first visit to the website to allow or disallow the use of cookies on their computer / device. This complies with legislation requirements for websites to obtain explicit consent from users before leaving behind or reading files such as cookies on a user’s computer / device.

Other cookies may be stored to your computers hard drive by external vendors when this website uses referral programs, sponsored links or adverts. Users contacting WAFFL about our Services do so at their own discretion and provide any such personal details requested at their own risk. Every effort has been made to ensure a safe and secure form to email submission process but advise users using such form to email processes that they do so at their own risk.

We use any information submitted to provide you with further information about the products / services to offer or to assist you in answering any questions or queries you may have submitted. This includes using your details to subscribe you to any email newsletter program the website operates but only if this was made clear to you and your express permission was granted when submitting any form to email process. Or whereby you the consumer have previously purchased from or enquired about purchasing from the company a product or service that the email newsletter relates to. This is by no means an entire list of your user rights in regard to receiving email marketing material. Your details are not passed on to any third parties.

Email Newsletter

WAFFL operates an email newsletter program, used to inform subscribers about products and services supplied by this website. Users can subscribe through an online automated process should they wish to do so but do so at their own discretion. Some subscriptions may be manually processed through prior written agreement with the user.

Subscriptions are taken in compliance with UK Spam Laws detailed in the Privacy and Electronic Communications Regulations 2003. All personal details relating to subscriptions are held securely and in accordance with the Data Protection Act 1998. No personal details are passed on to third parties nor shared with companies / people outside of the company that operates this website. Under the Data Protection Act 1998 you may request a copy of personal information held about you by this website’s email newsletter program. A small fee will be payable. If you would like a copy of the information held on you please write to the business address at the bottom of this policy.

Email marketing campaigns published by this website or its owners may contain tracking facilities within the actual email. Subscriber activity is tracked and stored in a database for future analysis and evaluation. Such tracked activity may include; the opening of emails, forwarding of emails, the clicking of links within the email content, times, dates and frequency of activity [this is by no far a comprehensive list]. This information is used to refine future email campaigns and supply the user with more relevant content based around their activity.

In compliance with UK Spam Laws and the Privacy and Electronic Communications Regulations 2003 subscribers are given the opportunity to un-subscribe at any time through an automated system.
